These Terms of Service ("Terms") govern the provision of outdoor timber construction services by CedarCraft Builds ("CedarCraft Builds", "we", "us" or "our") to you, our customer ("you" or "the customer"). CedarCraft Builds is operated by Manika Tamang and is based at 150A Plumstead Common Road, London, SE18 7DY, United Kingdom. By requesting a quotation, booking a project package, or instructing us to carry out work, you agree to be bound by these Terms. Please read them carefully and keep a copy for your records.
1. Definitions
In these Terms, "services" means the outdoor timber construction and related services we provide, including consultations, privacy screen installation, pergola construction, planter and seating projects, decorative timber features, outdoor living structures and bespoke garden projects. "Project" means a specific piece of work agreed between us. "Written proposal" means the document setting out the scope, materials, pricing and indicative timeline for a project. "Materials" means the timber, fixings and other components used in a project.
2. Scope of Services
CedarCraft Builds provides residential outdoor timber construction services. The exact scope of each project is defined in the written proposal provided to you before work begins. Our services are intended for residential properties and outdoor garden spaces. We do not provide commercial construction, structural building work outside the scope of garden structures, or any service not expressly described in your written proposal. Any work falling outside the agreed scope will be treated as a separate project and may require an additional proposal and cost.
All projects are delivered as one-time residential construction services. CedarCraft Builds does not offer subscriptions, maintenance plans, recurring billing arrangements, or membership programmes. Each project has a defined start and end point as described in the written proposal.
3. Enquiries and Consultations
When you contact us, we will discuss your requirements and, where appropriate, arrange a consultation or site review. For larger projects, we typically visit the property to assess the available space, ground conditions, access and intended use of the structure. The Outdoor Project Consultation package provides a structured assessment, project planning and recommendations tailored to your property. A consultation does not commit you to proceeding with construction work.
4. Quotations and Written Proposals
Following an enquiry or consultation, we prepare a written proposal setting out the scope of work, the materials to be used, the price and an indicative timeline. Quotations are based on the information available to us at the time and the requirements you have described. Prices displayed on our website are starting points; final pricing for bespoke or larger projects depends on the scope, dimensions, materials and site conditions.
A written proposal is valid for the period stated within it, or for 30 days where no period is specified. We reserve the right to revise a quotation if the requirements change, if access or site conditions differ materially from those described, or if unforeseen circumstances affect the work. Any revision will be communicated to you in writing, and work affected by the change will not proceed until you have approved it.
5. Acceptance and Booking
A project is confirmed when you accept the written proposal and, where applicable, complete the required payment. For project packages purchased through our website, payment is taken securely through our payment provider at the point of booking. For larger or bespoke projects, the payment arrangements are set out in the written proposal. By accepting a proposal or making a payment, you confirm that the scope, materials, price and timeline are as you require.
6. Project Planning and Scheduling
Once a project is confirmed, we will agree a schedule with you. Indicative timelines are provided in good faith but may be affected by factors outside our control, including weather, material availability, site access and circumstances on the day. We will keep you informed of any changes to the schedule. Where a project depends on access to your property, you are responsible for ensuring that safe and reasonable access is available on the agreed dates.
7. Customer Responsibilities
To enable us to carry out the work efficiently and safely, you agree to:
- Provide accurate and complete information about your property, requirements and any relevant restrictions;
- Ensure safe and reasonable access to the work area on the agreed dates;
- Obtain any necessary permissions, including from landlords, freeholders, neighbours or local authorities, where required;
- Confirm the position of any underground or concealed services, pipes, cables or drainage in the work area where known;
- Keep the work area reasonably clear and free from obstructions; and
- Inform us promptly of anything that may affect the project.
You are responsible for confirming whether your project requires planning permission or other consents. While we are happy to share general guidance, it remains your responsibility to ensure that any required permissions are in place. We are not liable for any consequences arising from a failure to obtain necessary permissions.
8. Materials
The materials to be used in your project are described in the written proposal. Timber is a natural product and may exhibit natural variations in colour, grain and texture, and may move, expand, contract or weather over time. These natural characteristics are not defects. Where you request specific materials or upgrades, this may affect the price and timeline, and will be confirmed in writing. Unless stated otherwise, ownership of materials passes to you once payment for the project has been received in full.
9. Construction Process
We carry out all work with reasonable skill and care and in a professional manner. We aim to keep the work area tidy and to minimise disruption. During construction, we may need to make minor adjustments to the agreed plan to account for site conditions; where any change materially affects the scope, price or timeline, we will discuss it with you before proceeding. We are not responsible for pre-existing defects in your property or for issues arising from concealed services or conditions that were not disclosed or reasonably apparent.
10. Completion and Project Review
Each project concludes with a completion walkthrough and project review. This is an opportunity for us to confirm that the work has been carried out in accordance with the written proposal and for you to raise any questions. If you identify any item that does not meet the agreed specification, please raise it during or promptly after the walkthrough so that we can address it. The project is considered complete once the agreed scope of work has been delivered.
11. Payments
Prices are quoted in pounds sterling (GBP). Payments for project packages are processed securely by Stripe. For larger projects, payment terms are set out in the written proposal and may include a deposit and a balance payment. All sums are due in accordance with the agreed terms. We do not store your card details. We reserve the right to suspend or withhold work where payments due have not been received in accordance with the agreed terms.
12. Cancellations and Refunds
Cancellations, scheduling changes and refunds are governed by our Refund Policy, which forms part of these Terms. Please review the Refund Policy carefully, as it explains how cancellations are handled at different stages of a project and how any refund is calculated.
13. Limitation of Liability
We carry out our work with reasonable skill and care. To the fullest extent permitted by law, CedarCraft Builds shall not be liable for any indirect, incidental or consequential loss, or for loss of profit, loss of enjoyment, or loss arising from circumstances outside our reasonable control. Our total liability arising out of or in connection with any project shall not exceed the total amount paid by you for that project. Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded or limited under applicable law. Nothing in these Terms affects your statutory rights as a consumer.
14. Warranties and Natural Materials
We stand behind the quality of our workmanship. However, because timber is a natural material exposed to the outdoor environment, normal weathering, movement, colour change and the effects of weather and use over time are to be expected and are not considered defects. Any specific guarantee relating to workmanship will be stated in your written proposal. Our warranties do not cover damage caused by misuse, neglect, alteration by others, extreme weather events, or a failure to carry out reasonable ongoing care.
15. No Recurring Billing
CedarCraft Builds does not operate any subscription, membership, recurring billing or automatic renewal arrangement. Every payment relates to a specific, one-time project. You will never be charged on a recurring basis. If you wish to commission further work in the future, this will be arranged as a new, separately agreed project.
16. Dispute Resolution
If you are dissatisfied with any aspect of our service, we encourage you to contact us as early as possible so that we can try to resolve the matter. Most concerns can be resolved quickly through open communication. Where a concern cannot be resolved informally, our Complaints Policy sets out the process we follow. If a dispute cannot be resolved between us, the parties may seek to resolve it through mediation before pursuing any other remedy. These Terms are governed by the laws of England and Wales, and the courts of England and Wales shall have jurisdiction.
17. Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to severe weather, acts of God, fire, flood, industrial action, supply shortages, or restrictions imposed by government or public authorities.
18. Changes to These Terms
We may update these Terms from time to time. The version applicable to your project is the version in force at the time your project is confirmed. We will provide the current Terms on request and will publish the latest version on our website.
19. Intellectual Property
All designs, drawings, written proposals, specifications and other materials prepared by CedarCraft Builds in connection with a project remain our intellectual property unless expressly agreed otherwise in writing. You may use these materials for the purpose of the project they were prepared for, but you may not reproduce, distribute or pass them to a third party for the purpose of carrying out similar work without our written permission. The contents of this website, including text, images and branding, are owned by or licensed to CedarCraft Builds and may not be copied or reused without consent.
20. Photography
From time to time we may wish to photograph completed work for our portfolio, website or marketing materials. We will only do so with your prior agreement, and any photographs will focus on the structure rather than identifiable personal details of your property. You may decline or withdraw this permission at any time by contacting us in writing.
21. Entire Agreement
These Terms, together with the written proposal for your project, our Refund Policy and our Privacy Policy, constitute the entire agreement between you and CedarCraft Builds in respect of the services. They supersede any prior discussions, representations or understandings, whether written or oral, except for any fraudulent misrepresentation. Where there is any conflict between these Terms and a written proposal, the written proposal shall prevail in respect of the specific project to which it relates.
22. Severability and Waiver
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Any failure or delay by us in enforcing a provision of these Terms shall not be treated as a waiver of our right to enforce that or any other provision in the future.
